01 Acceptance of Terms

By creating an account, accessing, or using Softmation (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms form a legally binding agreement between you and Softmation ("we," "us," or "our"). Our Privacy Policy is incorporated into these Terms by reference.

02 Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow children under 13 to register.

03 Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

  • Provide accurate and complete registration information.
  • Keep your password secure and not share it with others.
  • Notify us immediately of any unauthorized use of your account.
  • Not create more than one account or create an account on behalf of another person without permission.

04 User Content

You retain ownership of content you post on the Platform ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it in connection with operating and improving the Platform.

You represent that your User Content does not violate any third-party rights and complies with all applicable laws. We reserve the right to remove User Content that violates these Terms.

05 Prohibited Conduct

You agree not to:

  • Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene.
  • Impersonate any person or entity or falsely represent your affiliation.
  • Upload or share content that infringes on any intellectual property rights.
  • Distribute spam, malware, or any disruptive code.
  • Scrape, crawl, or systematically extract data from the Platform.
  • Interfere with or circumvent any security features.
  • Use the Platform for any illegal purpose or in violation of any applicable laws.
  • Post nudity, sexually explicit material, or graphic violence.

06 Live Streaming

The Platform allows users to broadcast and watch live video streams. When hosting a live stream, you are solely responsible for all content broadcast. You must not stream:

  • Content that violates these Terms or any applicable law.
  • Copyrighted material without the rights holder's permission.
  • Nudity, sexual content, or graphic violence.
  • Conduct that harasses, threatens, or demeans other users.

We reserve the right to terminate any stream at any time without notice. Stage (co-host) participants must comply with the same content standards as the host.

07 Coins & Gifts

The Platform offers a virtual currency ("Coins") that can be purchased using real money and used to send virtual gifts to hosts during live streams. Coins have no cash value and cannot be withdrawn or refunded except as required by law.

  • All coin purchases are final. We do not offer refunds for unused coins except where required by applicable law.
  • Coins expire if your account is suspended or terminated for violations of these Terms.
  • We reserve the right to adjust coin pricing and gift offerings at any time.
  • Coin balances are non-transferable between accounts.

08 Creator Subscriptions & Premium Content

Creators may offer paid subscriptions and premium posts. By subscribing, you agree to recurring charges at the stated frequency until cancelled. Subscription benefits are available during the active billing period.

  • Cancellation takes effect at the end of the current billing period.
  • We do not guarantee refunds for partial subscription periods.
  • Creators are responsible for fulfilling the content they offer to subscribers.

09 Payments & Wallet

The Platform provides a digital wallet for funding purchases. All wallet transactions are processed in the platform's default currency. You are responsible for ensuring sufficient funds before initiating any purchase.

We use third-party payment processors and do not store full payment card details. By making a payment, you agree to the terms of the applicable payment processor. Failed transactions may be retried and we will notify you of any issues.

10 Intellectual Property

The Platform and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. Our name, logo, and all related marks are our trademarks. You may not use them without our prior written consent.

11 Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.

12 Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for User Content posted by third parties.

13 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

14 Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the competent courts of the jurisdiction in which we operate, and you consent to personal jurisdiction in such courts.

15 Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you via email or a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

01 Information We Collect

We collect information you provide directly to us and information generated by your use of the Platform:

  • Account information: name, username, email address, password, profile photo, and bio.
  • Payment information: transaction records, wallet balance, and purchase history. Full card details are handled by our payment processors and not stored by us.
  • Content: posts, comments, photos, videos, live streams, and messages you create or send.
  • Usage data: pages viewed, features used, streams watched, search queries, and interaction logs.
  • Device information: device model, operating system, unique device identifiers, IP address, and browser type.
  • Location: approximate location derived from IP address. We do not collect precise GPS location.

02 How We Use Your Information

We use the information we collect to:

  • Operate, maintain, and improve the Platform.
  • Process transactions and manage your wallet and coin balance.
  • Send you account-related notifications, security alerts, and support messages.
  • Personalize your feed, recommendations, and content discovery.
  • Enforce our Terms of Service and community guidelines.
  • Detect, investigate, and prevent fraudulent or illegal activity.
  • Comply with legal obligations.

We do not sell your personal information to advertisers or other third parties.

03 Information Sharing

We do not sell or rent your personal data. We may share your information only in these limited circumstances:

  • With service providers: trusted vendors who assist in operating the Platform (e.g., hosting, payment processing, video infrastructure), bound by confidentiality obligations.
  • For legal reasons: when required by law, subpoena, or to protect the rights, property, or safety of our users or the public.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, with notice provided to you.
  • With your consent: in any other circumstance where you have given explicit consent.

04 Cookies & Tracking Technologies

We use cookies and similar technologies to keep you logged in, remember your preferences, and understand how the Platform is used. You can configure your browser to refuse cookies, though some features may not function properly without them.

We do not use advertising trackers or sell browsing data to ad networks.

05 Camera & Microphone Access

Our mobile app requests access to your device's camera and microphone exclusively to enable live streaming and video features. This access is used only when you actively use these features — we do not access your camera or microphone in the background.

Camera and microphone data are streamed in real-time and are not stored by us unless you or a viewer explicitly records a stream within the Platform's provided features.

06 Media & Storage Access

Our app may request access to photos and media stored on your device to allow you to upload profile pictures and post images or videos. We access only the files you explicitly select — we do not scan or index your full media library.

07 Data Retention

We retain your information for as long as your account is active or as needed to provide the Platform's services. When you delete your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law or for legitimate business purposes such as fraud prevention and dispute resolution.

08 Data Security

We implement industry-standard technical and organizational measures to protect your personal information, including encrypted data transmission (TLS), hashed passwords, and access controls. However, no method of transmission or storage is 100% secure. We encourage you to use a strong, unique password and to contact us immediately if you suspect unauthorized access to your account.

09 Children's Privacy

The Platform is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information. If you are a parent or guardian and believe your child has provided us with personal data, please contact us.

10 Your Rights

Depending on your location, you may have the right to:

  • Access: request a copy of the personal data we hold about you.
  • Correction: request that we correct inaccurate or incomplete data.
  • Deletion: request deletion of your personal data, subject to legal obligations.
  • Portability: receive your data in a structured, commonly used format.
  • Objection: object to processing of your data in certain circumstances.

11 Third-Party Services

The Platform integrates third-party services including video streaming infrastructure, payment processors, and analytics tools. These services have their own privacy policies and we encourage you to review them. We are not responsible for the privacy practices of third-party services.

12 Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting a notice on the Platform or by sending an email to the address associated with your account. Your continued use of the Platform after the effective date constitutes acceptance of the updated policy.
